COMPLIANCE ESTATAL EM NORMAS INTERNACIONAIS DE DIREITOS HUMANOS: A ESCOLHA RACIONAL COMO MODELO EXPLICATIVO

Objetivos: O objetivo do estudo é examinar o modelo explicativo da Escolha Racional. Intenta compreender a racionalidade de decisões dos atores estatais para o cumprimento de normas internacionais de direitos humanos.

Metodologia: Partindo da Escolha Racional como estrutura teórica, fez-se uma revisão da literatura. Após, interpretou as variáveis internas e externas para a adesão às normas de direitos humanos.

Resultados: Identificou-se argumentos e a racionalidade no sentido de constrangimento ou compliance com regras a partir de externalidades. Estas podem ser as demandas objetivas por recursos econômicos/materiais ou reduzir perdas significativas, como uma sanção/punição, perda de reputação ou de legitimidade. Esses ganhos (a serem maximizados) ou perdas (a serem abreviados ou eliminados) mobilizam os agentes de modo a fazerem opções.

Contribuições: O estudo contribui para a aplicação da Escolha Racional e a hermenêutica de direitos humanos. Contribui, assim, para a compreensão da tomada de decisão de agentes estatais nas relações internacionais.

ABSTRACT

Objective: The study objective is to examine the explicative model of the Rational Choice. It intends to comprehend the rationality of the state actors for the compliance of international human rights norms.

Methodology: Departing from the Rational Choice as a theoretical structure, I reviewed the literature. Additionally, I interpreted the internal (domestic factors) and external (foreign policy) for the adhesion of human rights norms.

Results: It identifies the arguments and the rationality in the sense of constraining or the compliance with rules due to externalities. Those variables can be objective demands for material/economic resources or to reduce important losses such as sanctions/punishments, the loss of reputation or legitimacy. The gains (to be maximized) or the losses (to be reduced or eliminated) mobilize the agents to select their choices.

Contributions: The study contributes for the application of the Rational Choice and for the hermeneutics of human rights. It contributes for the comprehension of the decision making of state agents in the international relations.
