SOLE MICROENTREPRENEUR: INSTRUMENT FOR THE EMPLOYMENT OF LEGAL PERSONS AS CONTRIBUTORS OF THE COMPANY IN THE ASCENSION OF THE LABOR REFORM

RESUMO

Objetivos: A temática proposta estuda o fenômeno sócio jurídico a partir do qual se verifica a possibilidade de conversão de empregados em trabalhadores inscritos como pessoas jurídicas na modalidade microempreendedor individual, espécie de pequena empresa, fato que atualmente se verifica como base da estrutura jurídica que se construiu a partir da reforma trabalhista de 2017.

Metodologia: A pesquisa adota uma abordagem indutiva, a técnica de pesquisa é bibliográfica, documental, legal e jurisprudencial e seu objetivo metodológico é exploratório e propositivo. 

Resultados: O artigo apresenta uma releitura crítica do parágrafo 1º. do artigo 18-A da Lei Complementar nº. 123/06, verificando a existência de meios regulamentares de contratação de agentes econômicos definidos no dispositivo legal em questão como profissionais autônomos que venham a atuar como colaboradores da empresa de forma análoga a empregados, sendo estes considerados nos termos do artigo 3º., da CLT; escrutinando eventuais alterações nos contornos atribuídos às relações jus laborais.

Contribuições: As resposta aos problemas indicados no introito desta pesquisa e verificação das respectivas hipóteses se dão a partir da releitura interpretativa dos normativos legais mencionados, explicando-os academicamente a partir do comparativo com os institutos que autorizam a contratação de prestadores de serviços pelas empresas por modalidades diferentes do contrato de trabalho e da terceirização, como o contrato de parceria regulado pela da Lei nº. 13.352/2016, que neste estudo serve de paradigma às reflexões desenvolvidas com o apoio dos preceitos jurisprudenciais que consolidam os conceitos e postulações de autores reconhecidos como estudiosos de temas conexos ao direito do empresarial do trabalho.

ABSTRACT

Objectives: The proposed theme studies the socio-legal phenomenon from which the possibility of converting employees into workers registered as legal persons in the individual micro-entrepreneur modality, a type of small company, a fact that is currently verified as the basis of the legal structure built as of the labor reformo f 2017.

Methodology: The research adopts an inductive approach, the research technique is bibliographic, documentary, legal and jurisprudential and its methodological objective is exploratory and propositional.

Results: The article presents a critical reinterpretation of paragraph 1 of article 18-A of Law No. 123/06, verifying the existence of regulatory means for hiring economic agents defined in the legal provision in question as independent professionals who come to act as collaborators to the company in a similar way to employees, which are considered under the terms of article 3 of Labor Law; scrutinizing possible changes in the contours attributed to labor relations.

Contributions:The answers to the problems indicated in the introduction to this research and the verification of the respective hypotheses are based on the interpretive rereading of the legal norms mentioned, explaining them academically from the comparison with the institutes that authorize the hiring of service providers by companies by different types of employment contract and outsourcing, such as the partnership contract regulated by Law No. 13.352/20 16, which in this study serves as a paradigm for the reflections developed with the support of jurisprudential precepts that consolidate the concepts and postulations of authors recognized as scholars of themes related to the entrepreneurial labor law.
