O presente artigo discute possibilidades e limites entre democracia e diretório nas relações internacionais a partir da criação do Centro Internacional para a Resolução de Diferendos Relativos a Investimentos entre Estados e Nacionais de outros Estados – CIRDI. Ainda, visa compreender a oposição dos Estados Latino-Americanos e o Princípio do Esgotamento dos Recursos Internos, dentre os aspectos abordados, os limites do consentimento para a o exercício da jurisdição do CIRDI. Por fim, destacar, para além da recepção e exportação de investimentos, sua conveniência na proteção de investidores nacionais prejudicados por atos soberanos de legalidade duvidosa oriundos de governos nacionalistas.

ABSTRACT

This article discusses the possibilities and limits of democracy in international relations and directory from the creation of the International Centre for Settlement of Investment Disputes between States and Nationals of other States. Still, aims to understand the opposition of the Latin American states and the principle of exhaustion of domestic remedies, among the issues addressed, the limits of consent to the exercise of jurisdiction of the said Council. Finally, highlight, besides the reception and export of investments, their convenience in protecting domestic investors harmed by sovereign acts of dubious legality from governments nationalists.
