DIREITOS HUMANOS EM NORBERTO BOBBIO: A TRAJETÓRIA DE UMA UTOPIA EM BUSCA DE CONCRETIZAÇÃO

Objetivo: O artigo tem como objetivo refletir sobre os direitos humanos estudados por Norberto Bobbio, especialmente sua historicidade, fundamento, judicialidade e efetivação. Procura esclarecer a influência que o autor tem exercido no Direito brasileiro.

Metodologia:A pesquisa tem natureza exploratória e baseou-se em textos publicados pelo autor em forma de livros. 

Resultados: Os resultados mostram que o pensamento de Norberto Bobbio exerceu e continua a exercer influência positiva na proteção, desenvolvimento e efetivação dos direitos humanos no Brasil. A construção de tais direitos teve no referido autor uma voz firma e propositiva não apenas para justificar a sua formalização, mas, principalmente, na busca incessante de sua efetivação

Contribuição: A pesquisa trata do legado de Norberto Bobbio em direitos humanos, o que permite engrandecer o papel não apenas da doutrina e da jurisprudência, mas também dos legisladores.

ABSTRACT

Objective: The article aims to reflect on the human rights studied by Norberto Bobbio, especially its historicity, foundation, legality and effectiveness. It seeks to clarify the influence that the author has had on Brazilian law.

Methodology: The research has an exploratory nature and was based on texts published by the author in the form of books.

Results: The results show that Norberto Bobbio's thought has exercised and continues to exercise a positive influence on the protection, development and effectiveness of human rights in Brazil. The construction of such rights had in the author a firm and purposeful voice not only to justify its formalization, but, mainly, in the incessant search for its effectiveness

Contribution: The research deals with Norberto Bobbio's legacy in human rights, which makes it possible to enhance the role not only of doctrine and jurisprudence, but also of legislators.
