REFORMA TRABALHISTA E O ESCAPE: PERSPECTIVAS WARATIANAS PARA UM RESGATE DA HUMANIDADE

Objetivo: O presente artigo busca a análise de alternativas desenvolvidas pelos estudos de Luis Alberto Warat que possam suprir as lacunas e distorções criadas pela Reforma Trabalhista, avaliando como uma análise reflexiva de suas teorias poderiam contribuir para suprir o cenário destrutivo das reformas legislativas.

Metodologia: O estudo apresentado baseia-se no método lógico e dedutivo, fazendo o uso da literatura de Luis Alberto Warat como referencial teórico para a apresentação de uma mediação que se proponha a contornar e enfrentar os problemas causados por mudanças e tendências neoliberais na legislação social.

Resultados: Como síntese alcançou-se o entendimento de que a teoria Waratiana é capaz de desenvolver uma escuta psicanalítica, bem como de contornar desafios necessários para a utilização da mediação. Além disso, identifica-se a necessidade de mudanças estruturais no ensino do direito, as quais impactariam em uma alteração central do conhecimento e da lógica jurídicas. 

Contribuições: O presente estudo declara a necessidade e a possibilidade de mudanças na sociedade e, sobretudo, nas relações trabalhistas. Por meio das reflexões nele trazidas, é possível considerar novas hipóteses e perspectivas sobre as relações laborais e a justiça do trabalho.

ABSTRACT

Objective: This article seeks the analysis of alternatives developed by Luis Alberto Warat's studies that can fill the gaps and distortions created by Labor Reform, assessing how a reflexive analysis of his theories could contribute to filling the destructive scenario of legislative reforms.

Methodology: The study presented is based on the logical and deductive method, using Luis Alberto Warat's literature as a theoretical reference for the presentation of a mediation that proposes to bypass and confront the problems caused by changes in neoliberal tendencies in social legislation.

Results: As a synthesis, the understanding that Waratian theory is capable of developing psychoanalytical listening, as well as of circumventing the challenges necessary for the use of mediation was reached. In addition, it was identified a need for structural changes in the teaching of Law, which would impact on a central change in knowledge and legal logic.

Contributions: The present study declares the need and possibility of changes in society and, above all, in labor relations. Through the reflections brought by it, it is possible to consider new hypotheses and perspectives on labor relations and labor justice.
