DIREITO E ARTE NA LIBERDADE DE EXPRESSÃO: QUANDO A ÉTICA SE PERDE NA ESTÉTICA

Este artigo investiga os limites da licitude da conduta humana abarcada sob o manto da arte, levantando-se a seguinte problemática: Como a relação entre a arte e a ética pode ajudar a definir que tipos de comportamentos são protegidos pelo direito à liberdade de expressão artística? Para elucidar a questão, o presente estudo tem como objetivo geral averiguar a idoneidade da ética como divisor de águas entre a arte e as manifestações mais deletérias da dignidade humana. Para tanto, foram delineados os contornos jurídicos do direito à liberdade de expressão, aclarados os conceitos de ética e arte a serem defendidos no estudo e fixados os parâmetros de aferição concreta da natureza dos comportamentos artísticos e não artísticos. A metodologia é a qualitativa, com abordagem na dialética e os métodos de procedimento são a revisão de literatura – jurídica e filosófica – e a análise de filmes. A hipótese que guia este estudo é a da inadmissibilidade de comportamentos antiéticos que, sob uma falsa escusa artística, promovem desserviços culturais, no paradigma civilizatório, invadindo a liberdade do próximo.

ABSTRACT

This article investigates the limits of the lawfulness of human conduct under the mantle of art, raising the following problematic: How the relationship between art and ethics can help to define what types of behavior are protected by the right to freedom of artistic expression? In order to elucidate the issue, the present study has as a general objective to ascertain the suitability of ethics as a watershed between art and the most deleterious manifestations of human dignity. In order to do so, the juridical outlines of the right to freedom of expression were outlined, clarifying the concepts of ethics and art to be defended in the study and establishing the parameters of concrete measurement of the nature of artistic and non-artistic behavior. It is used the qualitative methodology, with an approach in the dialectics and the methods of procedure are literature review - legal and philosophical - and film analysis. The hypothesis that guides this study is the inadmissibility of unethical behaviors that, under a false artistic excuse, promote cultural disservices, in the civilizing paradigm, invading the freedom of others.
