RESPONSABILIDADE CIVIL NO CASO DO MASSACRE DE PRESOS NO COMPLEXO PENITENCIÁRIO ANÍSIO JOBIM (COMPAJ), EM 1º DE JANEIRO DE 2017

Em janeiro de 2017, o Compaj foi tomado por rebelião que culminou com fugas e mortes. Alegando terceirização, tanto o presidente da República como o ministro da Justiça, imputaram responsabilidade pelos fatos ocorridos à empresa Umanizzare Gestão Prisional e Serviços Ltda. Investigou-se nesse artigo a atribuição da responsabilidade civil pela chacina ocorrida, por meio do método hipotético-dedutivo, partindo da hipótese da responsabilidade civil objetiva do Estado, sendo examinada, a evolução da responsabilidade do Estado, edital de licitação, termo de contrato nº 018/2014-Sejus, projeto básico, legislação pertinente e o posicionamento de autores sobre o tema. Concluiu-se pela confirmação da hipótese proposta.

ABSTRACT

In January 2017, the Compaj was taken by a rebellion that culminated with escapes and the deaths. Claiming outsourced work issues, both the President of the Republic and the Minister of Justice attributed responsibility for the events that occurred to the company Umanizzare Gestão Prisional e Serviços Ltda. It was investigated in this article the attribution of civil responsibility for the slaughter that occurred using the hypothetical-deductive method based on the hypothesis of objective civil responsibility of the State, being examined the evolution of State responsibility, the bidding notice, the contract term 018/2014-Sejus, the basic project of the service outsourced, pertinent legislations and the position of authors on the theme. It was concluded by the confirmation of the hypothesis proposed.
