O presente texto analisa a possibilidade de participação societária das operadoras de planos de saúde no quadro social de outras sociedades, em confronto com a regra do objeto exclusivo na saúde suplementar. Para tanto, analisar-se-á o conceito de objeto social das sociedades empresárias, a participação societária enquanto atividade integrante do objeto social, bem como as diferentes finalidades da participação societária. Diante desses elementos, buscar-se-ão os limites para a restrição à livre iniciativa e os parâmetros para a atuação regulatória.

ABSTRACT

This paper examines the possibility of corporate interest of health insurance operators in others companies in front of the exclusive corporate object rule in Supplemental Health. It will analyze the concept of corporate object, as well as the corporate interest as constitutive activity of them. It will show the different purpose of the corporate interest. From these elements, it will search for regulatory parameters to free enterprise restrictions.
