RESPONSABILIDADE CIVIL OBJETIVA DA EMPRESA POR ATOS DE CORRUPÇÃO A LUZ DA LEI 12.846/2013

RESUMO

O presente artigo pretendeu analisar a responsabilidade civil objetiva da empresa por atos de corrupção à luz da Lei nº 12.846/2013. Sabe-se que tal iniciativa popular foi fundamental para promulgação desta lei, onde o Congresso Nacional sentiu-se pressionado pelas manifestações, e tentou dar uma resposta positiva a sociedade brasileira com a elaboração da lei 12.846/2013, frente a impunidade e pandemia de corrupção enfrentada no país. A Lei Anticorrupção ficou amplamente conhecida pelas suas severas sanções às empresas, com a finalidade de repreender e prevenir a corrupção empresarial. É possível concluir que, como o Brasil ainda não possui a criminalização da corrupção no setor privado, a LAC atualmente, constitui-se de uma ferramenta vital para repressão e prevenção da corrupção no setor empresarial.

ABSTRACT

This article intends to analyze the objective civil liability of the company for acts of corruption in light of Law nº 12.846 / 2013. It is known that such a popular initiative was fundamental for the promulgation of this law, where the National Congress felt pressured by the demonstrations, and tried to give a positive response to Brazilian society with the drafting of law 12,846 / 2013, facing impunity and the corruption pandemic Faced in the country. The Anti-Corruption Law was widely known for its severe sanctions against companies, in order to reprimand and prevent corporate corruption. It is possible to conclude that, since Brazil does not yet have the criminalization of corruption in the private sector, LAC is currently a vital tool for repression and prevention of corruption in the business sector.
