ANATEL E LIMITAÇÃO DA BANDA LARGA DE INTERNET NO BRASIL: CASO CLÁSSICO DO EMBATE DOS GRUPOS DE INTERESSE NA REGULAÇÃO SETORIAL

O artigo analisa os regulamentos expedidos pela ANATEL relacionados à internet fixa, em especial a questão da limitação do serviço. Tal limitação se desdobra com a possibilidade de venda de acesso com franquia e a limitação na velocidade após o uso total da franquia pelo consumidor, ou a cobrança de adicional. O trabalho parte do marco teórico na teoria econômica da regulação de George Stigler, também conhecida como captura, e na teoria do Estado-fato de Léon Duguit. O objetivo é compreender a dinâmica dos grupos de interesse durante a elaboração desta política regulatória pela ANATEL.

ABSTRACT

The article analyzes the internet service (which can be called of “kind fixed”) from the

ANATEL’s regulations, especially the issue of internet service limitation. This limitation as possibility to sell internet using with limitation in speed after the full use of the franchise by the consumer, or additional tax collection.The framework is George Stigler’s Economic Theory of Regulation, also known as capture, and Léon Duguit’s State-fact theory. The aim is to understand the dynamics of the interests groups for the development of regulatory policy by ANATEL.
