O DEVER CONSTITUCIONAL DO ESTADO EM GARANTIR A SAÚDE: O USO DE MEDICAMENTOS EXPERIMENTAIS

O presente texto tem por escopo dissertar sobre o dever do Estado, em razão da Constituição Federal de 1988, de garantir o direito à saúde. Primeiramente será feito uma apresentação acerca do direito à saúde como parte fundamental do direito à vida. Em seguida, será abordada a trajetória do direito à saúde nas Constituições Brasileiras anteriores à 1988, bem como, a demonstração sobre a importância do Sistema Único de Saúde. Após, será apresentado o conceito e possibilidades de utilização dos medicamentos experimentais. Nesta perspectiva, será realizado um breve estudo de caso jurisprudencial, através do método dedutivo. Assim, portanto, serão apresentados julgados do tribunal de justiça do RS, no intento de verificar quais os posicionamentos acerca do dever do Estado em garantir a saúde, especialmente no que tange à utilização de medicamentos experimentais.

ABSTRACT

This text is to expound scope of the duty of the state, because of the 1988 Federal Constitution, to guarantee the right to health. First a presentation about the right to health as a fundamental part of the right to life will be. Then the trajectory of the right to health will be addressed in the Brazilian Constitutions prior to 1988 as well as the demonstration of the importance of the Unified Health System. Following will be presented the concept and possibilities of use of investigational medicinal products. In this perspective, there will be a brief study of jurisprudential case through the deductive method. So therefore, they will be presented judged the RS court of law, in an attempt to see which positions on the State's duty to ensure the health, especially regarding the use of experimental drugs.
