A FUNÇÃO SOCIAL DA FAMÍLIA NA PROMOÇÃO DO DIREITO À EDUCAÇÃO

A família é uma sociedade natural formada por pessoas em virtude dos laços sanguíneos, civis e afetivos. Os pais são os representantes legais dos filhos menores, os quais ainda se encontram em condição de vulnerabilidade até alcançarem a capacidade plena. Diante da necessária representação, o Estado prevê determinadas responsabilidades para com seus filhos, dentre as quais estão os deveres com relação aos aspectos educacionais de seus participantes. A educação é um direito fundamental, portanto, irrenunciável, e de acordo com o artigo 229 da Constituição Federal é papel da família, ou melhor, dos pais cumprir com o dever de assistir, criar e educar os filhos. Nesse sentido, o objetivo da presente pesquisa é estudar a função social da família na promoção do direito à educação dos filhos menores e a importância da relação família – escola – sociedade. O legislador constituinte reconheceu a relevância de proteger a família de modo especial, porque esta representa o espaço para o desenvolvimento da personalidade de todos os seus membros, o que somente é possível se for baseada na promoção do direito à educação. A função social da família é propiciar um ambiente saudável para o desenvolvimento de seus membros de forma digna, principalmente para os filhos menores, pois estes estão se moldando de acordo com os valores que lhe são repassados. Assim, entende-se que é importante que os pais façam o acompanhamento na vida escolar e educacional da criança, para que esta se torne um cidadão de bem, consciente de seus direitos e deveres.

ABSTRACT

The family is a natural society formed by people because of the blood, civil and emotional ties. Parents are the legal representatives of minor children, who are still in a position of vulnerability until they reach full capacity. Given the necessary representation, the state provides for certain responsibilities to their children, among which are the duties in relation to the educational aspects of its participants. Education is a fundamental right, therefore, indispensable, and in accordance with Article 229 of the Constitution is part of the family, or rather the parents comply with the duty to assist, raise and educate their children. In this sense, the objective of this research is to study the family's social role in promoting the right to education of minor children and the importance of family relationship - school - society. The constituent legislature has recognized the importance of protecting the particular family, because this is the space for the development of the personality of all its members, which is possible only if it is based on promoting the right to education. The family's social function is to provide a healthy environment for the development of its members in a dignified manner, especially for younger children, as they are shaping up according to the values that are passed. Thus, it is understood that it is important that parents do monitoring in school and educational life of the child, so that it becomes a good citizen, aware of their rights and duties.
