O DIREITO FUNDAMENTAL AO ESQUECIMENTO: UMA ANÁLISE COMPARATIVA DA EXPERIÊNCIA BRASILEIRA E EUROPEIA

O presente artigo analisou o direito fundamental ao esquecimento a partir da literatura especializada sobre o assunto e os principais julgados que se destacaram no âmbito do Direito Comparado, bem como a jurisprudência do Superior Tribunal de Justiça Brasileiro. Devido evolução tecnológica presenciada na atualidade, a privacidade do indivíduo às vezes é exposta com a divulgação de antigas condutas desabonadoras. O direito ao esquecimento é um direito fundamentalmente implícito e coloca-se como um meio de defesa, na medida em que visa excluir do conhecimento alheio aspectos da vida pessoal do indivíduo.

ABSTRACT The present article analyzed the fundamental right to oblivion from the specialized literature on the subject and the main judges that stood out in the scope of Comparative Law, as well as the jurisprudence of the Brazilian Superior Court of Justice. Due to the technological evolution witnessed at present, the privacy of the individual is sometimes exposed with the disclosure of old dishonorable behaviors. The right to forgetfulness is a fundamentally implicit right and is a means of defense, insofar as it seeks to exclude from the knowledge of others aspects of the individual's personal life.
