O CONFLITO ENTRE PRINCÍPIOS NA TEORIA ESTRUTURANTE DO DIREITO DE FRIEDRICH MÜLLER

RESUMO

O estudo que ora se apresenta tem por escopo abordar, a partir do constructo teórico de Friedrich Müller (2009), o modo de tratamento do conflito entre princípios na Teoria Estruturante do Direito. O âmbito normativo, a partir da metódica estruturante, se constitui em elemento da norma, sinalizando que o direito não se encerra num conjunto lógico de proposições, constituindo-se, antes, em sistema normativo que intenta dirigir a sociedade e, em paralelo, é influenciado por esta. O artigo procura demonstrar que a solução delineada pela Teoria Estruturante do Direito melhor atende o problema do conflito entre princípios, visto que considera o sistema jurídico como produto da ação concreta das pessoas, se consubstanciando numa proposta interpretativa eminentemente prática.

ABSTRACT

the paper presented here aims to address, from Friedrich Muller’s theoretical construct, the treatment mode of the conflict among the principles of the Law Structuring Theory. The regulatory framework, from the methodical structuring, constitutes in rule element, signaling that the Law does not end in a logical set of propositions, constituting itself, before, in a regulatory system which tries to run the society and, in parallel, is influenced by it. The study attempts to demonstrate that the solution outlined by the Law Structuring Theory best fits the problem of the conflict among principles, since it considers the legal system as a product of people concrete action, consolidating itself in an eminently practical interpretive proposal.
