A NECESSIDADE DE UM ESTUDO REFLEXIVO E INTERDISCIPLINAR PARA O AVANÇO FILOSÓFICO E CULTURAL DO DIREITO

RESUMO

O momento de reflexão sobre o avanço econômico e social fez com que se criasse o termo “pós-modernidade”. Com este, não somente bônus foram descobertos, mas diversos ônus a serem questionados pela sociedade jurídica ocidental. O refinamento filosófico necessário às mudanças encontra barreiras metodológicas que ficaram esquecidas no tempo. A herança que o Positivismo deixou para a Filosofia Jurídica, não somente afetou seu núcleo mas os seus métodos de ensino. O sentimento egocêntrico de unidade e consistência jurídica, afastou o Direito das influências externas e logo, acabou por cegá-lo às problemáticas que demais ciências já estavam enfrentando. Portanto, se faz extremamente necessário que o quanto antes, o Direito se faça uso da interdisciplinaridade para auxiliar na produção de uma nova cultural plural jurídica, abraçando novas temáticas, problemáticas e por assim, realizando às devidas alterações condizentes às mudanças dos novos estudos críticos do Direito.

ABSTRACT

The moment of reflection on the economic and social progress made to create the term “post-modernity”. With this, not only bonuses were discovered, but many burdens to the questioned by Western legal society. The philosophical refinement is necessary to change the methodological barriers that were forgotten in time. The heritage that the Positivism left for Legal Philosophy, affected not only the core but also his teaching methods. Egocentric sense of unity and legal consistency pushed the law of eventually blind the Philosophy to the problems that other sciences were already facing. Therefore, it’s very necessary that as soon as possible, the right to make use of interdisciplinarity to assist in the production of a new cultural legal plural, embracing new themes, issues and by so doing to consistent changes due to changing new critical legal studies.
