A ORESTEIA E A ORIGEM DO TRIBUNAL DO JÚRI

RESUMO

O artigo é dedicado à Oresteia, de Ésquilo, e adota a metodologia empregada nos estudos de direito na literatura. Inicialmente, é abordado o processo de apropriação dos mitos na composição das tragédias gregas; e, na sequência, são examinados o mito dos Atridas e os elementos figurativos apresentados na trilogia de Orestes, de modo a destacar que a transposição do dever de vingança ao direito de justiça é o núcleo temático no qual radica a importância que essa obra adquire, para a compreensão da cultura e do pensamento ocidental, enquanto representação literária da origem do tribunal do júri e, consequentemente, sua relevância para o Direito.

ABSTRACT

This article analyzes the Oresteia, by Aeschylus, and adopts the methodology used by Law in Literature studies. Initially, the process of appropriation of the myths in the composition of the Greek tragedies is approached; following to that, the myth of the Atridas and the figurative elements presented in the trilogy of Orestes are examined, in order to emphasize that the transposition of the duty of revenge to the right to justice is the thematic core in which lies the importance these poems acquire for the understanding of the Western culture, as they are literary representations of the origin of the jury court and its relevance to Law.
