O INTERESSE PÚBLICO E A SUSTENTABILIDADE DO PROJETO CONSTITUCIONAL

Busca o presente artigo repensar o conceito de interesse público à luz da Constitucionalização do Direito, da força normativa da Constituição e da sua sustentabilidade. Nesta medida, o faz, primeiro, diferenciando interesses egoísticos de interesses privados, e assentando que tanto não há um real antagonismo entre interesse público e interesse privado; como ainda não há uma automática supremacia entre interesses estatais e interesses de particulares. Demonstra, ainda, o artigo, que os interesses egoísticos podem vir do indivíduo, mas também do próprio Estado, de agentes políticos, de servidores públicos e que o próprio interesse da maioria pode revelar interesse egoístico. Neste diapasão, defende-se que o real interesse público é aquele vinculado ao projeto constitucional, que incentiva e homenageia a sua execução, o que está estritamente correlacionado à concretização dos direitos fundamentais, não só no presente, mas também, de forma sustentável, no futuro.

ABSTRACT

This article aims to rethink the concept of public interest in the context of the constitutionalism theory, the normative power and sustainability of the Constitutional rights. This paper does its tasks, first, distinguishing between selfish interests and private interests, and then arguing that there is no real antagonism between public interest and private interest. As well, there is not an automatic supremacy between state interests and private interests. It also demonstrates that selfish interests can come from the individual, but also from the state itself, the politicians, the civil servants and the people’s majority. This article also argues that the real public interest is that which encourages and honors the constitutional project, and, which is closely correlated to the realization of fundamental rights, not only nowadays, but also in a sustainable manner into the future.
