O TRABALHO COMO INSTRUMENTO DA PROMOÇÃO DA DIGNIDADE DO PRESO

RESUMO

O presente trabalho detém o escopo de investigar as funções atribuídas à reprimenda criminal, passando pelas teorias absolutas, nas quais se verifica o viés retributivo da sanção face ao mal praticado, até às teorias relativas de cunho terapêutico e ressocializatório. Na sequência, traçam-se pontos de contato entre o intento de reintegração social da pena e os valores e diretrizes constitucionais da nossa República. Finalmente, analisa-se o art. 28 da LEP, que erige o trabalho à condição de dignidade do apenado, paralelamente à compreensão hodierna de dignidade, concluindo-se pela legitimidade da atuação, ante à axiologia constitucional, de empresas socialmente conscientes que aliem seu escopo precípuo à colaboração com o processo de ressocialização dos detentos e egressos do sistema penal.

ABSTRACT

This study has the scope to investigate the functions assigned to the criminal reprimand, through the absolute theories, on which there were a retributive goal to the sanction against the evil practiced, to the theories of the therapeutic nature. Next, we sign points of contact between the intent of social reintegration of the penalty and the constitutional values ​​and guidelines of our Republic. Finally, we analyze the art. 28 of the Criminal Execution Law, with erects work to a condition of dignity, parallel to today's understanding of dignity, concluding to the legitimacy of the action, due the constitutional axiology, of the socially conscious companies that combine its primary scope for collaboration with the process of rehabilitation of inmates and ex-convicteds of the criminal system.
