A RELAÇÃO ENTRE DIREITO E MORAL NA ÓTICA DE KELSEN E HABERMAS: DA SEPARAÇÃO À COORIGINARIEDADE

Este trabalho apresenta uma pesquisa bibliográfica, orientada pela fenomenologia-hermenêutica, com o objetivo de refletir acerca do relacionamento entre Direito e moral, transitando, para tanto, nos conceitos do positivismo exegético e normativista, bem como nas perspectivas de Kelsen e Habermas sobre o tema. A relevância do trabalho se funda na necessidade de ampliar o olhar jurídico acerca da relação de sobreposição entre Direito e moral. Os pressupostos trazidos pela presente pesquisa, inclusive como elementos integrantes da argumentação jurídica, apresentam-se como ponto determinante para a busca da solução do conflito entre validade normativa, como parte do procedimento judicial de decidir, e aceitação moral, como pressuposto de legitimidade do Direito.

ABSTRACT

This paper presents a literature search, guided by phenomenology-hermeneutics, in order to reflect on the relationship between Law and morality, transiting, therefore, the concepts of exegetical positivism and normative as well as the perspectives of Kelsen and Habermas on the subject. The relevance of the work is founded on the need to expand the legal view about the overlapping relationship between Law and morality. The assumptions brought by this research, including as integral elements of legal arguments, are presented as decisive point in the search for solution to the conflict between normative validity as part of the judicial procedure to decide, and moral acceptance, as legitimacy assumption of Law.
