CASAMENTO ENTRE PESSOAS DO MESMO SEXO: A FRAGMENTAÇÃO DO DIREITO NA DECISÃO DA SUPREMA CORTE DOS ESTADOS UNIDOS

RESUMO

A pesquisa trata da decisão da Suprema Corte dos Estados Unidos, de junho de 2015, que definiu, por maioria de cinco votos, dentre os nove juízes, pelo reconhecimento do casamento entre pessoas do mesmo sexo. Após leitura e análise da decisão original, bem como de documentos relacionados e, ainda, com suporte em informações sobre o sistema de julgamento da Suprema Corte, foram listados e comentados os argumentos contrários, que formaram a minoria da decisão. A metodologia refere-se à revisão bibliográfica e estudo de caso, a partir da fonte da decisão. Concluiu-se pela insustentabilidade dos argumentos apresentados pelos juízes que formaram a minoria, diante das características do sistema norte-americano. Por fim, foram expostas considerações sobre temas que, ou não são mencionados, como é o caso da sexualidade e da heteronormatividade, ou cuja forma de tratamento pode ser contraposta, como é o caso da inclusão de homossexuais no conceito de casamento.

ABSTRACT

The research is about the decision of the Supreme Court of the United States, in June 2015, which defined by a majority of five votes, between the nine judges, the recognition of same-sex marriage. After reading and analyzing the original decision, related documents and also based in information about the Supreme Court judgment system, it were listed and commented the arguments against the same sex-mariage that supported the minority decision. The methodology refers to the literature review and case study from the source of the decision. It was concluded by the unsustainability of the arguments that were adopted by the judges who formed the minority group, in face of the US system characteristics. Therefore considerations were exposed on topics that are not mentioned, such as sexuality and heteronormativity, or whose form of treatment can be imposed, such as the inclusion of homosexuals in the concept of marriage.
