Liberdade negocial e dignidade da pessoa humana: aspectos relevantes

RESUMO

A dignidade da pessoa humana é princípio fundamental das Constituição

da República. Referido princípio serve de norte e objetivo para a ativida-

de econômica. A livre iniciativa, que alberga entre outras, a liberdade

contratual e a de empresa deve ser desenvolvida de forma a garantir a

todos uma existência digna. O contrato se constitui em importante e es-

sencial instrumento para o desenvolvimento econômico e se constitui, no

vértice da pessoa humana, em meio de aprimoramento e desenvolvimen-

to da personalidade. Conciliar uma cultura econômica capitalista onde o

Direito deve ser interpretado através das regras econômicas, fortemente

arraigada na sociedade pátria, com a realidade constitucional em que o

ser humano está à frente do patrimônio, é um desafio.

ABSTRACT

ThThe human dignity is the fundamental principle of the Constitution of

the Republic. That principle serves as the north and goal for economic

activity. The free enterprise, which houses among others, the freedom of

contract and the company should be developed to guarantee everyone a

decent life. The contract constitutes an important and essential tool for

economic development and represents the apex of the human person, in

the midst of improvement and development of personality. Bringing a

capitalist economic culture in which the law should be interpreted by the

economic rules, strongly rooted in society homeland, with the constitutional

reality that the human being in front of the property, is a challenge.
