JUSNATURALISMO E FUNÇÃO SOCIAL DO DIREITO: A ORIGEM MÍTICA DO DIREITO NATURAL E A FUNÇÃO SOCIAL SOB AS LUZES NO NATURALISMO

RESUMO

O presente estudo parte da noção de mito como explicação do mundo da vida para concluir que a tutela dispensada às pessoas na Antiguidade era vinculada não à disposições legais e sim, muitas vezes, ao culto mítico que tinha plena aceitação social, o que conferia um caráter metafísico à proteção daquele que recebia “dons” de deidades, como a vida. O direito natural como expressão cultura e social é enxergado dentro desta concepção, não necessitando a tutela humana o reconhecimento por autoridade alguma. A análise das diferenças entre o direito natural e o direito positivo são apontadas para estruturar o tópico seguinte que liga a primeira expressão jurídica, o jusnaturalismo, com a função social da propriedade de forma a conferir melhores condições de proteção e óbices à proteção deficiente na sociedade líquida.

ABSTRACT

This study of the notion of myth as an explanation of the living world to conclude that the protection given to the people in antiquity was not linked to the legal provisions but often the mythical cult that had full social acceptance, which gave the character metaphysical protection that he received "gifts" of deities, like life. Natural law as culture and social expression is see within this design, requiring no human supervision recognition by some authority. The analysis of the differences between natural law and positive law are aimed to structure the next topic that connects the first legal expression, the natural law with the social function of property in order to give better protection conditions and obstacles to poor protection in liquid society.
