RESPONSABILIDADE CIVIL DO MÉDICO E CONSENTIMENTO INFORMADO NA VISÃO DO SUPERIOR TRIBUNAL DE JUSTIÇA - STJ

RESUMO

Este estudo parte da relação privada entre o médico seu paciente considerando-a uma relação de consumo, com a aplicação das regras e princípios do Código de Defesa do Consumidor – CDC. Caracterizada a informação como direito subjetivo do paciente, analisa-se de que modo pode, e deve, ocorrer a materialização deste dever pelo médico enquanto fornecedor. Assim, busca-se demonstrar que o direito à informação constitui-se como um direito básico do paciente-consumidor, havendo inclusive regras deontológicas que versam sobre a matéria, para, ao final, verificar como deve ser manifestado seu consentimento para que se considere adimplida a obrigação médica informacional segundo a doutrina especializada. Por fim, analisa-se o posicionamento do Superior Tribunal de Justiça – STJ, através de estudo pormenorizado de sua jurisprudência.

ABSTRACT

This study of the private relationship between doctor his patient considering it a consumer relationship with the application of the rules and principles of the Consumer Protection Code - CDC. Characterized the information as a subjective right of the patient, we analyze how it can, and should, occur the materialization of this duty by the doctor as a supplier. Thus, we seek to demonstrate that the right to information constitutes a basic right patient-consumer and there are even ethical rules that deal with the matter, for in the end, check how it should be expressed their consent to consider adimplida the informational obligation under the specialized medical doctrine. Finally, we analyze the position of the Superior Court of Justice - STJ, through detailed study of its jurisprudence.
