STATUS LEGAL DOS ENTREGÁVEIS INTELECTUAIS: A AUTORIA DE TRABALHOS GERADOS POR IA

Résumé


Objetivo. O estudo considera a autoria de obras criadas por inteligência artificial e propõe um conceito alternativo dentro do qual as relações jurídicas no campo dos direitos autorais baseados em IA possam ser regulamentadas.

Métodos. Os métodos de pesquisa são baseados na análise de um número limitado de estudos selecionados de acordo com parâmetros especiais e revisados de forma abrangente. Os autores também utilizam o método de analogia e análise comparativa.

Resultados. Os principais conceitos de autoria de IA e as características e particularidades da IA forte são considerados. Com base nos resultados do estudo, conclui-se que a IA forte, capaz de criar obras únicas e originais, pode ser definida como um quase-sujeito com direitos e responsabilidades limitados.

Conclusões. A IA como um quase-sujeito deve ser reconhecida como um sujeito autorizado, mas não obrigado, das relações jurídicas. No direito autoral, pode ter o direito de autoria e publicação da obra. Os criadores da IA e terceiros envolvidos na sua criação e uso devem exercer direitos de propriedade.
