A CULTURA DA PERSONIFICAÇÃO E A FORMAÇÃO DE UM DIREITO SOCIETÁRIO INTERNACIONAL

Abstract


Postula-se a inviabilidade de construção de um Direito Societário Internacional. Em pesquisa de abordagem qualitativa e metodologia dedutiva, o artigo divide-se em três partes. Inicialmente, discorre-se sobre a formação de um novo espaço público, porém, distinto do Direito público, tradicionalmente conhecido. Em seguida, sustenta-se a impossibilidade de construção de um Direito Internacional empresarial.  A cultura da personificação, inevitavelmente, reafirma o caráter local das empresas e a incoerência de transplantes jurídicos. Na terceira parte, finalmente, apresenta-se uma solução ao caleidoscópio normativo empresarial. O Direito Internacional Privado, empregado como um projeto dedicado à manutenção da pluralidade, auxiliaria a salvaguarda dos principais valores advogados nesse novo espaço público.
