CRITERIA FOR DIFFERENTIATING ADMINISTRATIVE AND CRIMINAL LIABILITY FOR UNAUTHORIZED ABANDONMENT OF A MILITARY UNIT
Resumo
Objective: This study examines the criteria for differentiating administrative and criminal liability for the unauthorized abandonment of a military unit in Ukraine. It aims to analyze the legal framework governing this offense, establish clear distinctions between administrative and criminal responsibility, and propose legislative improvements to enhance military discipline while protecting the rights of servicemembers.
Method: The research employs a legal and comparative analysis approach, examining the Criminal Code of Ukraine and the Code of Ukraine on Administrative Offenses. The study also incorporates case law review, doctrinal legal analysis, and an assessment of international standards related to military discipline and liability.
Results: The findings indicate that administrative and criminal offenses related to unauthorized abandonment share common legal characteristics but differ in severity, subject classification, and duration of absence. The study identifies key distinctions in the legal nature of each offense and highlights inconsistencies in current legislation. Additionally, the recent introduction of exemptions from criminal liability for servicemembers voluntarily returning to their units is analyzed, raising concerns about potential misuse and corruption risks.
Conclusion: The research underscores the need for legislative refinement to clearly delineate the boundaries between administrative and criminal liability. Recommendations include establishing a uniform qualification process for offenses, addressing gaps in legal interpretation, and ensuring procedural safeguards to maintain military discipline while protecting servicemembers’ rights. Strengthening the legal framework will contribute to more effective enforcement and fairness in military justice.
