A ATUAÇÃO DO TRIBUNAL PENAL INTERNACIONAL: UMA RETOMADA HISTÓRICA A PARTIR DOS TRIBUNAIS AD HOC

Resumo

O presente estudo busca identificar o impacto do Tribunal Penal Internacional, para o direito internacional humanitário e os direitos humanos, passando pela sua origem e as cortes que o antecederam. A importância deste trabalho repousa no papel que os Tribunais Internacionais exercem, por intermédio de suas decisões, para concretizar e aplicar num contexto fático real, os direitos assegurados nas Convenções e Tratados internacionais. Assim, o ato de apresentar os Tribunais ad hoc na presente pesquisa, tendo em vista o papel que eles exerceram para a concretização de direitos dentro de cenários de conflitos, além de serem o precedente jurídico para o Tribunal Penal Internacional, é essencial. Logo, para compreender o papel da mencionada corte na contemporaneidade, explorou-se seu Estatuto fundador, bem como casos reais em que o tribunal exerceu sua jurisdição. Com o auxílio de pesquisa bibliográfica e jurisprudencial, demonstra-se a importância de um efetivo judiciário internacional para remediar violações já praticadas, coibir futuras e assegurar a concretização de direitos na realidade.

ABSTRACT

The present paper intends to identify the impact of the International Criminal Court, for International Humanitarian Law and Human Rights, going through its origin and the courts that preceded it. This research is important because it brings to the discussion the role that International Courts play, through their decisions, to materialize and apply in a real and factual context, the rights guaranteed in international Conventions and Treaties. Thus, the act of presenting the ad hoc Courts in the present research, in view of the role they played in the realization of rights within conflict scenarios, in addition to being the legal precedent for the International Criminal Court, is essential. Therefore, in order to understand the role of the aforementioned Court in contemporary times, its founding Statute was explored, as well as real cases in which the court exercised its jurisdiction. With the help of bibliographic and jurisprudential research, the importance of an effective international judiciary is demonstrated to remedy violations already committed, curb the future and guarantee the realization of rights in reality.
