O presente artigo, faz uma análise objetiva do momento atual do Estado Brasileiro e sua dificuldade de cumprir o dever de suprir os direitos fundamentais para com o cidadão, dentro de sua ação estatal constitucional. A análise se dará, ante a situação econômica e financeira atual por que passamos, sinalizando-se a intervenção estatal, como resolução paliativa ao problema do atendimento das exigências constitucionais aos ditos princípios fundamentais, com forte atuação reguladora estatal ante a escassez de recursos para tal fim.

ABSTRACT

This article makes an objective analysis of the current Brazilian State situation and its difficulty to fulfill the duty to supply the fundamental rights to the citizen, within its constitutional state action. The analysis is made before the current economic and financial situation we are living, signaling the state intervention as a palliative resolution to the problem of meeting constitutional requirements to these fundamental principles, with strong state regulatory action in the face of the scarcity of resources for such purpose.
