Resumo
Neste artigo se investiga a persistência e efetividade da cláusula da Nação Mais Favorecida (NMF) do GATT/OMC diante das sobretaxas implementadas pelos EUA desde 2018, sob Trump (mandatos I e II) e Biden. A partir de análises empíricas, jurídicas e econômicas, discute-se o enfraquecimento do sistema não discriminatório, impactos nas cadeias globais, no desempenho econômico e na governança da OMC. Conclui-se que, ainda que formalmente vigente, a NMF está fragilizada e demanda renovado compromisso institucional para coibir abusos tarifários. Particularmente pela OMC.
