OS DIREITOS SUBJETIVOS E A CONCRETIZAÇÃO DA JUSTIÇA NA ERA DIGITAL

Nessa nova configuração de tecnologias e desenvolvimento, outros aspectos passaram a ter relevância para o direito e para a sociedade. A partir disso é importante investigar alguns conceitos a respeito dos direitos subjetivos e sua forma concreta, e como a tecnologia tem trazido ao direito esses problemas legais que fazem com que o judiciário tenha dificuldades ao decidir considerando a ausência de normas que regulam certos meios. Neste sentido o presente artigo foi exposto. Utilizando-se a metodologia para o desenvolvimento do artigo por meio de pesquisa bibliográfica, mediante explicações embasadas em trabalhos publicados em livros, artigos e revistas. A importância do estudo deriva do fato em que as tecnologias passaram a serem muito utilizados na era em que vivemos sendo conhecida como era digital, e isso trouxe suas vantagens mas traz consigo algumas implicações quanto a efetividade dos direitos e liberdades exercidas pelo cidadão e que afetam todos, mesmo os que não tem acesso a estas tecnologias.

ABSTRACT

In this new configuration of technologies and development, other aspects have become relevant to the law and to society. From this it is important to investigate some concepts about subjective rights and their concrete form, and how technology has brought to law these legal problems that make the judiciary have difficulties in deciding considering the absence of rules that regulate certain means. In this sense the present article was exposed. Using the methodology for the development of the article through bibliographical research, through explanations based on works published in books, articles and journals. The importance of the study stems from the fact that technologies have come to be widely used in the era in which we live being known as the digital age, and this has brought its advantages but brings with it some implications as to the effectiveness of the rights and freedoms exercised by the citizen and affecting all, even those who do not have access to these technologies.
