O ASSÉDIO MORAL E AS CONSEQUÊNCIAS DA VIOLAÇÃO DA PERSONALIDADE E DA DIGNIDADE DO TRABALHADOR NO MEIO AMBIENTE LABORAL

RESUMO

A empresa para ser cidadã deve respeitar a dignidade de seus trabalhadores. O assédio moral cometido no ambiente de trabalho viola a personalidade de seu trabalhador merecendo uma reprimenda por parte do poder judiciário, diante da violação desse núcleo sagrado e intangível que cada um de nós somos portadores. Deve a empresa respeitar os direitos de seus trabalhadores, sob pena de responder pelos atos advindos do assédio moral, seja cometido pelos seus prepostos, seja cometido por qualquer trabalhador no meio ambiente laboral, ou seja, de forma vertical ou horizontal haverá a proteção do cidadão trabalhador, da consequência advinda desse ato tão nefasto na vida pessoal e profissional. O trabalho, que ora se propõe, inicia-se com um estudo sobre o assédio moral, após adentra na legislação aplicável sobre o assédio moral no direito interno brasileiro, sobretudo em face da violação da personalidade e dignidade humana, trazendo ao final as consequências do assédio moral na vida de um trabalhador, diante dos abusos cometidos no meio ambiente empresarial, colacionando ainda algumas jurisprudências para exemplificar e cientificar a atividade empresarial das consequências nefastas da violação do direito da personalidade do trabalhador.

ABSTRACT

The company to be a citizen must respect the dignity of its workers. The harassment committed in the work environment violates the personality of its worker deserving a reprimand on the part of the judiciary, before the violation of this sacred and intangible core that each of us are carriers. Should the company respect the rights of its workers, failing to respond to acts arising from moral harassment, whether committed by its employees or committed by any worker in the labor environment, that is, vertically or horizontally, there will be citizen protection Worker, from the consequence of such an ominous act in personal and professional life. The work, which is proposed here, begins with a study on moral harassment, after entering into the applicable legislation on moral harassment in Brazilian domestic law, especially in the face of violation of personality and human dignity, bringing to the end the consequences of Moral harassment in the life of a worker, in the face of abuses committed in the business environment, and also collate some jurisprudence to exemplify and scientific the business activity of the harmful consequences of violation of the right of the personality of the worker.
