A SÚMULA 294, DO TST E SUA (IN) COMPATIBILIDADE COM O ARTIGO 7º, INCISO XXIX, DA CONSTITUIÇÃO FEDERAL E O PRINCÍPIO DA PROTEÇÃO DO TRABALHADOR

RESUMO:

Este artigo apresenta a análise sobre a Súmula 294, do TST à luz da Constituição de 1988 e do princípio da proteção. Para tanto, discorre sobre o princípio da proteção e as fontes formais do Direito do Trabalho. Ainda, apresenta a distinção entre princípio e norma e expõe o conceito a prescrição. Em sequência aborda-se a prescrição na Constituição Federal, a prescrição parcial e a total no Direito do Trabalho e a prescrição na jurisprudência do TST. Para então, discutir a prescrição total da súmula 294, do TST e sua afronta ao artigo 7º, inciso XXIX, da Constituição Federal e ao princípio da proteção do trabalhador e, por fim, apresentar as críticas doutrinárias à referida Súmula 294.

ABSTRACT:

An analysis of the Precedent 294 of the TST is presented in light of the current Brazilian Constitution and the principle of protection. Therefore this paper approachs to the principle of protection and formal sources of labor law. Moreover, principle and norm are distinguished and the prescription is conceptualized. After that, are addressed the prescription in the Brazilian Constitution, the partial and total prescriptions in the Labor Law and the prescription in jurisprudence of the TST. This paper discusses the full prescribing precedent 294 of the TST and how it affronts the Article 7, XXIX, of the Brazilian Constitution and the principle of protection of the worker. Ultimately, are presented the doctrinal criticism to that Precedent 294.
