(IM) POSSIBILIDADE DO PROTESTO EXTRAJUDICIAL DO CONTRATO COM GARANTIA DE ALIENAÇÃO FIDUCIÁRIA DE BEM IMÓVEL

O presente artigo aborda os institutos do Protesto Extrajudicial e o da Alienação Fiduciária. Busca-se fazer uma análise dos efeitos do protesto e da definição de quais documentos estão aptos a serem protestados após o advento da Lei 9.492/97. Para se definir se a existência de disposição expressa nos artigos 26 e seguintes da Lei 9.514/97 de procedimento especifico – perante a serventia de registro imobiliário – para a comprovação da mora de contrato garantido por alienação fiduciária de bem imóvel, afasta ou não a possibilidade do credor requer o protesto extrajudicial. O tema é relevante, pois atualmente no Brasil, o instituto da alienação fiduciária tem sido um dos mais utilizados quando se busca a garantia real de um bem imóvel, e também pelo protesto ter se tornado uma forma de cobrança rápida e eficaz que atenda aos interesses dos credores mas sem violar direitos dos devedores.

ABSTRACT

This article addresses the institutes of the Extrajudicial Protest and the Fiduciary Alienation. It seeks to analyze the effects of the protest and the definition of which documents are likely to be protested after the advent of Law 9.492 / 97. In order to establish whether the existence of a provision expressly set forth in articles 26 et seq. Of Law 9.514 / 97 of a specific procedure - in the case of a real estate registry - for the proof of the contract default guaranteed by fiduciary disposal of immovable property, Of the creditor requires extrajudicial protest.
