SOCIEDADE DE RISCO, DEFINIÇÃO DEMOCRÁTICA DO RISCO E SEGURANÇA JURÍDICA

RESUMO

O presente artigo parte da análise da sociedade de risco, como forma de explicar as profundas transformações ocorridas na sociedade pós-moderna. Ainda que as grandes transformações na vida social contemporânea signifiquem avanços e vantagens, apresentaram inúmeros efeitos colaterais negativos, que trouxeram novas ameaças, novos riscos para a humanidade, os quais são irreversíveis, invisíveis e de escala global. Com o objetivo da precaução e prevenção dos riscos derivados da sociedade de riscos, os agentes propulsores da globalização, focados no aumento da produtividade e expansão mercadológica, acabaram por ficar dependentes da ciência, a qual poderia identificar, estudar, analisar e apontar os riscos. Contudo, a racionalidade científica, que vive um momento de profunda revisão diante das incertezas metodológicas, não consegue dar conta das definições dos riscos civilizacionais. Nesta esteira, o fracasso das ciências em conhecer dos riscos, fez com que os cientistas e produtores de risco, delegassem parte do seu poder de definição a sociedade. Com um Legislativo debilitado para formação de um consenso político, impulsionou o Poder Judiciário a decidir sobre tais riscos, para gerar estabilidade nas relações sociais e segurança jurídica.

ABSTRACT

The present article starts from the analysis of the society of risk, as a way of explaining the profound transformations that occurred in postmodern society. Although the great transformations in the contemporary social life signify advances and advantages, they displayed numerous negative side effects, that brought new risks for the humanity, which are irreversible, invisible and of global scale. With the objective of precaution and prevention of the risks, the agents of globalization, focused on increasing productivity and market expansion, became dependent on science, which could identify, study, analyze and point out risks. However, scientific rationality, which is experiencing a moment of profound revision in the face of methodological uncertainties, can not provide the definitions of those new risks. In this vein, the failure of the science, made the scientists and producers of risk, delegate part of their power of definition to society. With a weak Legislative for the formation of a political consensus, it impelled the Judiciary to decide about those risks, in order to form social estabilityand legal safety.
