RESUMO

Este artigo apresenta um estudo acerca da Análise Econômica do Contrato e as implicações da função social no comércio internacional, com o objetivo de analisar a correlação da Análise Econômica do Contrato e a função social do contrato no âmbito dos contatos internacionais. O presente estudo apresenta considerações sobre a Análise Econômica do Direito, demonstrando a justificativa de sua utilização no ordenamento jurídico brasileiro, e ainda, as implicações da função social do contrato nos contatos internacionais. Pretende-se analisar mais profundamente o novo enfoque jurídico da relação contratual internacional, já que mudanças foram operadas no sentido de enriquecer as relações jurídicas, demonstrando quais seriam os meios para efetivar o cumprimento das cláusulas contratuais trazendo certa segurança aos investimentos estrangeiros. Por fim, refletir acerca das funções desempenhadas pela AED e pela função social e suas consequências jurídicas no âmbito internacional.

ABSTRACT

This article presents a study on the Economic Analysis of Contract and the implications of social function in international trade, in order to analyze the correlation of Economic Analysis of Contract and the social function of the contract under international contacts. This study presents considerations on the Economic Analysis of Law, demonstrating the rationale for their use in the Brazilian legal system, and also the implications of the social function of the contract in international contacts. We intend to analyze more thoroughly the new legal approach to international contractual relationship, since changes were operated in order to enrich the legal relations, showing what are the means to effect compliance with contractual clauses bringing some security to foreign investment. Finally, reflect on the functions performed by the EDA and social function and their legal consequences internationally.
