FISCALIZAÇÃO DE CONTRATOS ADMINISTRATIVOS: A IMPORTÂNCIA DOS FISCAIS DE CONTRATO ADMINISTRATIVOS NO ÂMBITO DA POLÍCIA MILITAR DO AMAZONAS

RESUMO

A Polícia Militar do Amazonas por ser unidade gestora de recurso público realiza aquisições e contratações de serviços e produtos para a consecução de sua missão constitucional, a presente pesquisa buscou verificar a importância dos fiscais de contratos administrativos no âmbito da Polícia Militar do Amazonas, Os objetivos operacionais foram: discorrer sobre a legislação, da jurisprudência dos tribunais de contas acerca das decisões envolvendo servidores que ocupavam as funções de fiscais; relatar as boas práticas de fiscalização de contratos administrativos em manuais disponibilizados pela web outros Estados e órgãos; levantar os documentos que tratam sobre a temática a fim de se constatar sua importância para a Instituição Polícia Militar do Amazonas que ocorreu entre os dias 07 de novembro de 2019 a 12 de novembro de 2019. A metodologia aplicada foi pesquisa bibliográfica e levantamento documental junto aos setores da Polícia Militar do Amazonas responsáveis pela instrução processual desde a fase interna da licitação até o pagamento das despesas. Os resultados obtidos pela pesquisa foram: a) não há cultura de fiscalização de contratos por parte dos setores da Polícia Militar do Amazonas envolvidos com a instrução dos processos licitatórios, bem como os responsáveis pelas etapas da despesa; b) Não há costume em oficializar a participação do fiscal nas novas licitações, uma vez que não há nenhum encaminhamento a eles partindo daquele setor; c) não houve instrução para os militares designados para a fiscalização de contratos; d) O setor de pagamento da Diretoria de Finanças efetivamente foi quem fiscalizou contratos.

ABSTRACT

The Military Police of Amazonas, as a public resource management unit, makes acquisitions and contracts for services and products for the accomplishment of its constitutional mission. operational were: to discuss the legislation, the jurisprudence of the courts of accounts about decisions involving civil servants who occupied the duties of inspectors; to report on the good practices of inspection of administrative contracts in manuals made available on the web by other States and agencies; to raise the documents dealing with the subject in order to verify its importance for the Military Police Institution of Amazonas, which took place between November 7, 2019 and November 12, 2019. The methodology applied was bibliographic research and documentary survey with the sectors of the Military Police of Amazonas responsible for the procedural instruction from the internal bidding phase until the payment of expenses. The results obtained by the research were: a) there is no culture of inspection of contracts by the sectors of the Military Police of Amazonas involved with the instruction of the bidding processes, as well as those responsible for the expenditure stages; b) There is no custom in making official the participation of the supervisor in the new tenders, since there is no referral to them from that sector; c) there was no instruction for the military personnel assigned to inspect contracts; d) The payment department of the Finance Directorate was actually the one who supervised contracts.
