SÍNDROME DA ALIENAÇÃO PARENTAL

RESUMO

Este estudo acadêmico tem o escopo de analisar a questão da Síndrome da Alienação Parental, abarcando-se, aqui, um estudo mais aprofundado a respeito do tema, até chegar ao momento em que este assunto, que vem ocasionando tanta repulsa pela sociedade, vem sendo tratado no âmbito dos tribunais pátrios. É certo que mais especificamente quando se trata da questão da alienação parental, esta normalmente se desencadeia em razão da atuação daqueles que possuem maior proximidade com o menor, principalmente pelo “genitor alienante”. Assim sendo, o intuito precípuo é efetuar o afastamento daqueles que se amam em virtude de uma campanha de desmoralização do “agente alienado”, cujas consequências não estão adstritas apenas na separação daqueles que possuem um vínculo afetivo, mas especialmente na interferência psíquica daquele que está em desenvolvimento. Nesses termos, em prol da dignidade da pessoa humana, bem como do melhor interesse do menor, medidas acertadas estão sendo tomadas pelo Poder Judiciário nos casos em que se evidenciam este ato, como a configuração da responsabilidade civil, cujo tema será melhor desmembrado no decorrer da pesquisa.

ABSTRACT

This academic study has the scope of analyzing the issue of the Parental Alienation Syndrome, with a more in-depth study of the subject, until the moment when this subject, which has caused so much repulsion by society, is being in the courts of the country. It is true that more specifically when it comes to the question of parental alienation, this is usually triggered by the performance of those who are closest to the minor, especially by the "alienating parent." Thus, the main aim is to remove those who love themselves by virtue of a campaign of demoralization of the "alienated agent," whose consequences are not only related to the separation of those who have an affective bond, but especially to the psychic interference of the one who is under development. In these terms, in favor of the dignity of the human person, as well as in the best interest of the minor, correct measures are being taken by the Judiciary in cases where this act is evidenced, such as the configuration of civil responsibility, whose theme will be better dismembered in the course of the research.
