FINANCIAMENTO ELEITORAL E ÉTICA EMPRESARIAL: A PARTICIPAÇÃO DAS EMPRESAS NO PROCESSO ELEITORAL

RESUMO

O presente trabalho tem por objetivo analisar a participação das empresas no processo de financiamento das campanhas eleitorais sob o prisma da ética empresarial, considerando para tanto a legislação eleitoral que rege a matéria, em especial as novas leis 13.487/2017 e 13.488/2017, que criaram nova forma de financiamentos, como o financiamento coletivo virtual e o Fundo Especial de Financiamento de Campanha (FEFC) e ainda, a decisão do Supremo Tribunal Federal exarada no julgamento da Ação Direta de Inconstitucionalidade nº 4.650. Procura-se verificar de que forma o poder econômico atua para desequilibrar a disputa eleitoral, comprometendo a representatividade e também a legitimidade da atuação das empresas no processo eleitoral.

ABSTRACT

The objective of this study is to analyze the participation of the companies in the process of financing the electoral campaigns under the prism of business ethics, considering for both the electoral legislation that governs the matter, especially the new laws 13.487/2017 and 13.488/2017, which created a new form of financing, such as virtual collective funding and the Special Fund for Campaign Finance (FEFC) and yet, the decision of the Supreme Court in the judgment of the direct action of unconstitutionality nº. 4,650. It seeks to verify how the economic power acts to unbalance the electoral dispute, compromising the representativeness and also the legitimacy of the activities of the companies in the electoral process.
