Este trabalho busca investigar em que medida a imprevisibilidade e a insegurança jurídica de decisões judiciais criam externalidades negativas para os empreendimentos econômicos e afetam a economia de mercado. De proêmio, o trabalho aborda notícia histórica do problema no contexto jurisdicional brasileiro. Em seguida, busca-se analisar as causas do cenário de aguda instabilidade da jurisprudência. O estudo pretende, ainda, verificar se as reformas legislativas no processo civil contemporâneo conferem maior previsibilidade ao sistema e minoram as consequências da crise jurisdicional. Examina-se também as possíveis soluções legais ao problema, tais como o incipiente microssistema de precedentes brasileiro, as alterações referentes aos requisitos de fundamentação das decisões jurisdicionais e o estímulo aos mecanismos alternativos de resolução de litígios. A pesquisa apresenta como resultado a constatação de que a falta de previsibilidade e segurança nas decisões judiciais produz efeitos maléficos para a economia de mercado, ao elevar os custos de transação e afetar a livre iniciativa (art. 1º, IV, CR) e, por consequência, o desenvolvimento econômico, mas que tal problema pode ser minorado a partir de institutos jurídico-processuais existentes. A metodologia empregada é de pesquisa bibliográfica e legislativa, com aplicação de conceitos da Análise Econômica do Direito.

This work seeks to investigate the extent to which the unpredictability and legal uncertainty of judicial decisions create negative externalities for economic enterprises and affect the market economy. As a headline, the work addresses historical news of the problem in the Brazilian jurisdictional context. Next, we seek to analyze the causes of the scenario of acute instability in jurisprudence. The study also intends to verify whether legislative reforms in the contemporary civil process provide greater predictability to the system and alleviate the consequences of the jurisdictional crisis. Possible legal solutions to the problem are also examined, such as the incipient microsystem of Brazilian precedents, changes regarding the requirements for substantiating jurisdictional decisions and the encouragement of alternative dispute resolution mechanisms. The research results in the finding that the lack of predictability and security in judicial decisions produces harmful effects for the market economy, by increasing transaction costs and affecting free enterprise (art. 1, IV, CR) and, therefore, consequence, economic development, but that this problem can be alleviated through existing legal-procedural institutes. The methodology used is bibliographic and legislative research, with the application of concepts from the Economic Analysis of Law.
