RESUMO

Objetivo: O presente artigo pesquisa a possibilidade de aplicação da teoria neofuncionalista para aperfeiçoamento da regulação e aprofundamento da integração regional, tendo como marco teórico Philippe C. Schmitter. De igual forma será trabalhada a temática do meio ambiente para a compreensão da aplicação do neofuncionalismo na União Europeia, destacando sua essencialidade aos seres humanos, bem como, sua regulação adotada pelo sistema europeu. Posteriormente, será apresentada a forma como essa organização supranacional estabelece sua competência em matéria ambiental e os instrumentos utilizados para tal.

Metodologia: O presente trabalho foi desenvolvido sob a metodologia jurídico-teórica e abordagem dedutiva, com a técnica de pesquisa bibliográfica e documental.

Resultado: Conclui-se pela possibilidade de aplicação do neofuncionalismo para justificar a integração da União Europeia e sua correlação com a proteção ambiental.

Contribuições: Entender o desenvolvimento de uma efetiva política ambiental a partir do Direito europeu, justificando a escolha, por ser o meio ambiente direito fundamental ao ser humano. Demonstrando a forma de integração sistêmica e os instrumentos utilizados em matéria ambiental sob uma teoria política das relações internacionais.

ABSTRACT

Objective: This article investigates the possibility of applying the neofunctionalist theory to improve regulation and deepen regional integration, with Philippe C. Schmitter as its theoretical framework. The theme of the environment will also be worked on to understand the application of neofunctionalism in the European Union, highlighting its essentiality to human beings, as well as its regulation adopted by the European system. Later, it will be presented how this supranational organization establishes its competence in environmental matters and the instruments used for this.

Methodology: The present work was developed under the legal-theoretical methodology and deductive approach, with the technique of bibliographic and documentary research.

Results: It concludes by the possibility of applying neofunctionalism to justify the integration of the European Union and its correlation with environmental protection.

Contributions: Understand the development of an effective environmental policy based on European law, justifying the choice, as the environment is a fundamental right to human beings. Demonstrating the form of systemic integration and the instruments used in environmental matters under a political theory of international relations.
