RESUMO

Um dos maiores problemas verificados na história recente da República Federativa do Brasil encontra-se localizado na área de segurança pública. Não se deve perder de vista que outras mazelas assolam, indistintamente, os brasileiros ainda mais nas áreas da saúde, educação e da economia. Mas o presente trabalho traz ao lume é a discussão sobre a possível violação dos direitos da personalidade em razão da concessão que pode ser feita pelo Poder Judiciário por intermédio da expedida de “mandados judiciais genéricos” de busca e apreensão. É de um truísmo exacerbado o fato de que em situações de crise como a vivida no Rio de Janeiro haja um transbordamento das práticas legais em razão da repressão ao crime organizado. Ocorre que diante do conflito entre Estado Democrático de Direito e a preservação dos Direitos Fundamentais o Poder Judiciário não pode quedar-se inerte, nem tampouco ficar passivo diante da guerra que será travada em solo fluminense, ainda mais diante da possibilidade concreta de violação a direitos essências ao Estado Democrático de direito.

ABSTRACT

One of the biggest problems in the recent history of the Federative Republic of Brazil is located in the area of public security. It should not be lost sight of the fact that other ills plague, indistinctly, Brazilians even more in the areas of health, education and the economy. But the present work brings to the fore is the discussion about the possible violation of the rights of the personality due to the concession that can be made by the Judiciary through the issuance of "generic judicial warrants" for search and seizure. It is an exaggerated truism that in situations of crisis such as that experienced in Rio de Janeiro there is an overflow of legal practices due to the repression of organized crime. It happens that, in the face of the conflict between the Democratic State of Law and the preservation of Fundamental Rights, the Judiciary can not remain inactive, nor can it remain passive in the face of the war that will be waged in Rio de Janeiro, even more so given the concrete possibility of violation of rights to the democratic state of law.
