COMPREENSÃO DO ATUAL COMPLEXO CIENTIFICO-JUDICIÁRIO: UM NOVO MODO DE ESTUDAR AS LEIS PENAIS

RESUMO

O presente artigo científico trata da compreensão da origem do atual complexo cientifico-judiciário à luz dos preceitos e regras trazidas pela obra Vigiar e Punir do filósofo francês Michel Focault. Busca analisar o método cientifico utilizado pelo autor para palmilhar na episteme da pena e da evolução do crime e da semiotécnica das punições, sendo certo que para tanto, faz-se uma breve exposição das reflexões do autor exarado na objurgada obra. Derradeiramente, objetiva trazer à baila as modulações do sistema penal hodierno e, por conseguinte analisar o deslocamento abstrato das leis penais e um novo jeito de estuda-las.

ABSTRACT

This article deals with the scientific understanding of the origin of the current scientific and judicial complex in the light of the principles and rules brought by Discipline and Punish work of the French philosopher Michel Foucault . Analyzes the scientific method used by the author to tread in episteme pen and evolution of crime and semiotics of punishment , given that to this end, we present a brief summary of the author's reflections recorded in work . Lastly, aims to bring up the modulations of today's criminal justice system and therefore analyze abstract displacement of criminal laws and a new way to study them
