da teoria institucionalista de Santi Romano, bem como de atos normativos. Como resultado da presente pesquisa, apura-se que o CONAR reflete a teoria institucionalista de Santi Romano com a sua estrutura orgânica, concreta, real, efetiva e com o Direito que lhe é próprio; autorregulamenta-se e não necessita da interferência do Estado para que os sujeitos que a compõem admitam e reconheçam as decisões do Conselho de Ética, como órgão solucionador de conflitos do CONAR, que compreende, para os incrédulos que reconhecem somente a força normativa do aparelho estatal, uma foça cogente efetiva derivada de seu próprio e exclusivo ordenamento.

ABSTRACT: The present paintends to analyze the National Council for Advertising Self-Regulation (CONAR) from the perspective of legal pluralism that rejects the univocal matrix of legal monism that conceives the State as the only normative producing source, as well as its formalist paradigm. The objective pursued is to denote the role of CONAR as an institution in line with the theoretical construction regarding the legal system of Santi Romano and legal pluralism. The deductive method is used, through the bibliographic and documentary review of works and scientific papers related to the institutionalist theory of Santi Romano, as well as normative acts. As a result of this research, it is found that CONAR reflects the institutionalist theory of Santi Romano with its organic, concrete, real, effective structure and with its own Law; it is self-regulating and does not need the interference of the State for the subjects that compose it to admit and recognize the decisions of the Ethics Council, as CONAR's conflict-solving body, which comprises, for the unbelievers who recognize only the normative force of the state apparatus, an effective cogent force derived from its own and exclusive order.
