A DESCONSIDERAÇÃO DA PERSONALIDADE JURÍDICA

RESUMO

Este artigo tem por objetivo apresentar análise sobre o instituto da desconsideração da personalidade jurídica. Apoia-se em uma pesquisa bibliográfica doutrinária e jurisprudencial. De início, tratou-se a respeito da caracterização da personalidade jurídica, inclusive no aspecto empresarial e suas formas de constituição. Por fim, o tema analisado a desconsideração da personalidade jurídica, mediante pesquisa bibliográfica, buscou-se estabelecer as questões históricas, bem como saber quais os critérios aceitos pela doutrina para sua ocorrência. Na sequência, analisaram-se as normas que tratam da desconsideração da personalidade jurídica, bem como algumas decisões judiciais sobre o assunto.

ABSTRACT

This article aims to present an analysis about the institute of the disregard of legal personality. It is based on a doctrinal and jurisprudential bibliographical research. Initially, it dealt with the characterization of the legal personality, including in the business aspect and its forms of constitution. Finally, the subject analyzed the disregard of legal personality, through bibliographical research, sought to establish the historical issues, as well as to know what criteria accepted by the doctrine for its occurrence. In the sequence, we analyzed the norms that deal with the disregard of the legal personality, as well as some judicial decisions on the subject.
