A MEDIAÇÃO A ARBITRAGEM E A CONCILIAÇÃO PARA A RESOLUÇÃO DE CONFLITOS EMPRESARIAIS

O presente artigo busca identificar como a mediação e a arbitragem podem ajudar na resolução de conflitos empresariais praticado no Brasil, e no Mercosul, após às inovações trazidas pelo Código de Processo Civil Brasileiro de 2015, ressaltando-se a importância para o desenvolvimento da arbitragem no ordenamento jurídico brasileiro. Foi realizada uma abordagem histórica, apontando os requisitos necessários e as dificuldades encontradas, seja em virtude das diversidades dos ordenamentos estrangeiros, seja por causas jurídico ideológicas. Serão analisadas as características inerentes à mediação, à arbitragem e à conciliação nos três ordenamentos diversos, dentre outros, para ao final, se identificar o tratamento dos meios alternativos de solução de conflitos pelo ordenamento jurídico, sua amplitude e suas consequências e sua importância.

ABSTRACT

This article seeks to identify how mediation and arbitration can help resolve corporate conflicts in Brazil and Mercosur, following the innovations brought by the Brazilian Code of Civil Procedure of 2015, emphasizing the importance for the development of arbitration in the Brazilian legal system. A historical approach was made, pointing out the necessary requirements and the difficulties encountered, whether due to the diversity of foreign systems or ideological legal reasons. The characteristics inherent to mediation, arbitration and conciliation in the three different systems will be analyzed, among others, in order to identify the treatment of alternative means of conflict resolution by Brazilian legal systems, their breadth and complexity. Its consequences and its importance.
