O presente artigo tem como objetivo central desenvolver um panorama acerca da crise da função jurisdicional, partindo-se do pressuposto de que o Poder Judiciário desenvolve papel marcante na busca da efetivação da Constituição Federal dirigente. Ao final, defende-se a desconstrução da hierarquia jurisdicional, com o fito de ressaltar a importância da atuação de órgãos não estatais na solução de conflitos, como forma de efetivar o acesso à justiça.

ABSTRACT

The present article has as main objective to develop a panorama about the crisis of the jurisdictional function, starting from the assumption that the Judiciary plays an important role in the search of the effective Federal Constitution. In the end, it is defended the deconstruction of the jurisdictional hierarchy, in order to emphasize the importance of the non-state organs acting in the solution of conflicts, as a way of effecting access to justice.
