PRIMEIRAS IMPRESSÕES SOBRE O ESTADO E O DIREITO SOCIAL DA SAÚDE EM COTEJO COM O CORONAVIRUS (COVID 19) E OS EFEITOS JURÍDICOS DAÍ DECORRENTES

RESUMO

Objetivo: O objetivo do presente artigo é uma reflexão sobre as primeiras impressões envolvendo o Estado e o direito social da saúde, como um direito e garantia fundamental prevista na Constituição vigente, a respeito da pandemia do coronavirus (convid 19) e os efeitos jurídicos.

Metodologia: Ante a escassez de bibliografia científica sobre a temática, adota-se a opção da pesquisa exploratória, procedendo-se a um levantamento de informações sobre a pandemia do coronavirus (covid 19), a fim de revelar os seus problemas atualmente vividos. Vale-se, também, quando a temática comporta, da pesquisa da legislação, de doutrina, e de sítios de notícias e informações na internet.

Resultados: Após colher as informações e dados sobre a pandemia, foi o momento de se fazer uma reflexão sobre as primeiras impressões da pandemia e de suas consequências jurídicas, apontando, como resultado, a gravidade dos problemas causados por ela, a fragilidade das pessoas nas sociedades, porquanto os Estados, de um modo geral, não estavam e não estão preparados para dar uma resposta efetiva, eficaz e ágil para estancar esse problema. Os sistemas de saúde dos Estados não estavam estruturados, nos aspectos físicos, materiais, financeiros e de pessoal, para enfrentar a pandemia.

Contribuições: É possível afirmar que se vive, praticamente, no escuro, como se estivesse no meio de uma neblina, porquanto as autoridades de saúde e sanitárias não têm, neste momento, soluções aptas e adequadas a conter a pandemia, não havendo remédios eficazes e tampouco vacinas, estando, ainda, na indicação de medidas paliativas, como a recomendação do isolamentos social, evitar aglomerações, distanciamento, utilização de máscaras, utilização de água e sabão, álcool 70°, para higiene, dentre outras. Propõe-se, como contribuição, a alteração de legislação, como já vem acontecendo, em várias setores do ordenamento jurídico, para atacar as várias facetas da problemática, em especial a criação de um fundo específico de forma permanente, para aaplicação em casos tais, minimizando a crise da saúde, que também não deixa de ser financeira.

ABSTRACT

Objective: The objective of this paper is to reflect on the first impressions involving the State and the social health law, as a fundamental right and guarantee provided for in the current Constitution, regarding the coronavirus pandemic (covid 19) and the legal effects.

Methodology: In view of the scarcity of scientific bibliography on the subject, it is adopted the option of exploratory research, proceeding with a survey of information about the coronavirus pandemic (covid 19), in order to reveal its currently experienced problems. It is also useful, when the theme included, the research of legislation, doctrine, and news and information sites on the internet.

Results: After gathering information and data about the pandemic, it is time to reflect on the pandemic's first impressions and its legal consequences, pointing out, as a result, the seriousness of the problems caused by it, the fragility of people in societies, because the States, in general, were not and are not prepared to give an effective, efficient and agile response to stop this problem. The health systems of the States are not structured, in physical, material, financial and personnel aspects to face the pandemic.

Contributions: It is possible to affirm that one lives, practically, in the dark, as if in the middle of a fog, as the health and sanitary authorities do not, at this moment, have apt and adequate solutions to contain the pandemic, there being no effective and effective remedies. nor vaccines, being, still, in the indication of palliative measures as the recommendation of the social isolations to avoid agglomerations, distance, use of masks, use of water and soap, 70° alcohol, for hygiene among others. As a contribution, it proposes the alteration of legislation, as it has already been happening, in various sectors of the legal system, to attack the various facets of the problem, in particular the creation of a specific fund on a permanent basis, for application in such cases, minimizing the health crisis, which is also financial.
