ÉTICA EMPRESARIAL E FUNÇÃO SOCIAL BUSINESS ETHICS AND SOCIAL FUNCTION OD THE COMPANY

RESUMO

O presente artigo aborda sobre a temática da ética e da função social empresarial, além de passar por questões atinentes ao positivismo jurídico e a função do direito enquanto instrumento de garantias e direitos. Baseado nos métodos dedutivos e indutivos e nos procedimentos de pesquisa de material bibliográfico objetiva-se encontrar suporte para proporcionar a análise e apontar considerações a respeito da ética empresarial, do jusnaturalismo e juspositivismo, com observância aos princípios estáticos e dinâmicos do direito e por fim, ponderar sobre a função social da empresa. Para tanto, inicialmente se analisa questões que fazem referência à ética empresarial. Em um segundo momento se apresentará o direito positivo e o direito natural enquanto teorias jurisdicionais. E ao final, se analisa de um aspecto econômico a ética empresarial e, de um jurídico, o positivismo para vislumbrar questões relacionadas à função social da empresa.

ABSTRACT

This article discusses about the subject of business ethics and corporate social function and about legal positivism and the role of law as an instrument of guarantees and rights. Based on deductive and inductive methods and procedures in bibliography research, the objective is to find support to provide analysis and point to considerations regarding business ethics, natural law and juspositivism with respect to static and dynamic principles of law and order, ponder the social function of property. For this purpose, initially analyzes relating to business ethics. In a second moment will present positive law and natural law as jurisdictional theories. Moreover, at the end, is analyzed an economic aspect to the business ethics and, the legal aspect to the positivism, in order to understand the social function of the company.
