Bem jurídico penal supraindividual e a obrigatoriedade de repressão .

RESUMO

A noção de bem jurídico é essencial para a garantia da coexistência em um Estado Democrático de Direito, como na forma adotada pelo sistema constitucional brasileiro. Mas o reconhecimento de funções especiais ao Estado a partir do século XX implicou também o reconhecimento de novos bens jurídicos que não são exatamente iguais àqueles para os quais o sistema penal foi programado originalmente, chamados, então, de bens jurídicos supraindividuais. Partindo-se da noção de que existem mandados constitucionais de criminalização para a proteção de certos bens jurídicos, é de se perguntar se também os bens jurídicos supraindividuais de cunho econômico não estariam protegidos por essas determinações. Na medida em que a própria figura do bem jurídico serve a garantir o indivíduo, a resposta parece ser no sentido contrário, identificando a possibilidade, não a obrigação, da criminalização das condutas economicamente lesivas apenas quando necessárias à salvaguarda do próprio indivíduo.

ABSTRACT

The notion of juridical interest is essential to ensure the coexistence in a democratic State based on the rule of law, as in the form adopted by the Brazilian constitution. The recognition of special functions to the State in the twentieth century caused the rising of new juridical interests – the so called supraindividual juridical interests – that doesn’t have the same characteristics as classical juridical interests. Based on the notion that there are constitutional orders to criminalize certain conducts, mainly those that violate individual interests, the question proposed is whether this obligation to criminalize may also affect supraindividual interests of an economical nature. However, as the notion of juridical interest is designed to protect the citizen by creating limitations to the ius puniendi, the answer seems to be negative: there is a possibility, not an obligation, to criminalize conducts that jeopardize economical supraindividual interests. This criminalization would be fair only when those conducts cause risks to individuals and their rights.
