O MUNICÍPIO ENQUANTO ESPAÇO DE CONSOLIDAÇÃO DE DIREITOS: A SAÚDE COMO BEM COMUM DA COMUNIDADE

Na contemporaneidade, as constantes transformações sociais proporcionam à humanidade um processo evolutivo contínuo de construção e desconstrução. Percebe-se que ao lado de cada avanço pode-se ter também um retrocesso, assim como à cada conquista de direito pode-se ter a limitação deste próprio direito. Todavia, neste cenário atual, também constata-se que é somente na humanidade e através da humanidade que pode-se alterar esta situação, ou seja, é à partir deste contexto que se pode pensar em um outro espaço capaz de neutralizar desigualdades e proporcionar direitos. Nestes termos, o presente texto tem como objetivo fomentar a discussão acerca deste espaço propulsor de direitos – o Município. E, em especial, demonstrar que é neste espaço que se encontram possibilidades para discutir o acesso e efetivação do direito à saúde como um bem comum à toda a comunidade. Logo, seguindo este ideário através de um estudo bibliográfico que segue o método hipotético dedutivo, é possível perceber-se que as condições de saúde de uma população podem ser um indicador importante do quanto a humanidade é humana ou desumana, do quanto ela de fato e de direito impulsiona a efetivação da cidadania.

In contemporary times, constant social transformations provide humanity with a continuous evolutionary process of construction and deconstruction. It is noticed that along with each advancement one can also have a retrocession, as well as to each conquest of right one can have the limitation of this own right. However, in this current scenario, it is also seen that it is only in humanity and through humanity that this situation can be altered, ie it is from this context that one can think of another space capable of neutralizing inequalities and providing rights . In these terms, the present text aims to foment the discussion about this propulsory space of rights - theMunicipality. And, in particular, to demonstrate that it is in this space that possibilities are available to discuss the access and fulfillment of the right to health as a common good for the whole community. Therefore, following this ideology through a bibliographic study that follows the hypothetical deductive method, it is possible to perceive that the health conditions of a population can be an important indicator of how humankind is human or inhuman, Of law drives the effectiveness of citizenship.
